TERMS & CONDITIONS – DIVING TRIP PACKAGE
1. General
By booking and participating in any diving or snorkeling activity, guests confirm that they have read, understood, and agreed to these Terms & Conditions. All activities are conducted in accordance with Indonesian law, Raja Ampat Marine Protected Area (MPA) regulations, and internationally recognized diving safety standards.
2. Certification & Experience Requirements
- All certified divers must present a valid diving certification card and logbook upon request.
- Minimum certification required:
- Open Water Diver for basic dive sites.
- Advanced Open Water Diver or equivalent may be required for sites with strong currents, deeper profiles, or drift diving.
- The dive center reserves the right to:
- Limit dive depth and sites.
- Require a check dive.
- Cancel or modify dives if a diver’s skill level is deemed insufficient.
3. Health & Medical Fitness
- All guests must be medically fit to dive.
- A completed medical statement is required prior to diving.
- Any medical conditions, recent surgeries, pregnancy, or medications must be declared in advance.
- The dive operator is not responsible for incidents arising from undeclared medical conditions.
4. Safety & Diving Conduct
- Divers must follow:
- Dive briefings.
- Guide instructions.
- Depth, time, and air-management limits.
- Buddy diving is mandatory unless otherwise instructed.
- Dangerous or reckless behavior may result in immediate termination of diving activities without refund.
5. Environmental Protection & Conservation Rules
Raja Ampat is a highly protected Marine Protected Area (MPA).
Guests MUST:
- Maintain proper buoyancy.
- Not touch, stand on, or lie on corals.
- Not chase, harass, feed, or manipulate marine life.
- Not remove or damage any marine organism or object.
- Respect No-Anchor Zones, mooring buoys, and local conservation rules.
- Any environmental damage caused by a guest may result in:
- Immediate termination of the trip.
- Fines, compensation claims, or legal action in accordance with Indonesian law and customary (adat) regulations.
6. Dive Site Selection & Conditions
Dive sites are selected based on:
- Weather
- Sea conditions
- Tides and currents
- Guest experience levels
- Raja Ampat currents can be strong and unpredictable.
- The operator reserves the right to:
- Change dive sites.
- Cancel dives for safety reasons.
No refunds will be issued for site changes due to safety or environmental conditions.
7. Equipment Responsibility
- Guests are responsible for checking their own equipment before each dive.
- Rental equipment must be returned in the same condition as received.
- Loss or damage due to negligence will be charged to the guest.
8. Insurance
- All divers are strongly required to have valid diving insurance (e.g. DAN or equivalent).
- The dive operator is not responsible for medical costs, evacuation, or hyperbaric treatment.
9. Payments, Cancellations & Refunds
Full or partial payment may be required to confirm a booking.
Cancellations:
- Weather-related or safety cancellations are non-refundable.
- Missed dives due to late arrival, illness, or personal reasons are non-refundable.
- Refunds are not provided for unused dives.
- 10. Photography & Video
- Underwater photography is allowed only if buoyancy control is adequate.
- Use of strong strobes or video lights may be restricted to protect marine life.
- Any damage caused during photography activities is the responsibility of the guest.
11. Liability & Risk Acknowledgment
- Diving and snorkeling involve inherent risks.
- By participating, guests accept full responsibility for their actions.
- The dive operator, guides, and staff shall not be held liable for:
- Personal injury
- Loss or damage of personal belongings
- Accidents beyond reasonable control
12. Local Authority & Customary Law
- Guests agree to respect:
- Indonesian national regulations.
- Raja Ampat MPA rules.
- Local customary (adat) laws enforced by indigenous communities.
- Violations may be reported to:
- Local patrol authorities
- Conservation agencies
- Law enforcement bodies
13. Acceptance of Terms
By booking, signing the registration form, or participating in any activity, guests confirm their full acceptance of these Terms & Conditions.
14. SPECIAL REFUND TERMS & CONDITIONS
14.1 Non-Refundable Services
All diving and snorkeling packages are non-refundable once the trip has commenced. This includes, but is not limited to:
- Unused dives
- Missed dives due change arrival
- Early departure
- Personal illness or fatigue
- Seasickness or discomfort
- Failure to meet fitness or certification requirements
14.2 Weather, Sea & Safety Conditions
No refunds will be issued for dive cancellations or site changes due to:
- Weather conditions with life safety considerations
- Safety decisions made by the dive operator or dive guide are final and non-negotiable.
14.3 Marine Park & Government Restrictions
No refunds shall be granted in the event of:
- Temporary closure of dive sites
- Marine Protected Area (MPA) restrictions
- Government orders
- Conservation enforcement actions
- Customary (adat) regulations imposed by local communities
14.4 Medical & Fitness-Related Cancellations
No refunds will be issued if a guest:
- Fails to declare a medical condition
- Is deemed unfit to dive after assessment
- Is denied diving for safety reasons
- Medical certificates presented after booking or arrival do not qualify for refunds.
14.5 Environmental Violations
Any guest removed from diving activities due to:
- Coral damage
- Marine life harassment
- Violation of MPA or conservation rules
will forfeit all remaining dives without refund.
- Additional penalties, fines, or compensation claims may apply under Indonesian law and customary regulations. Be Aware that Raja Ampat is highly Marine Protected Area Zone under Minister of Fishery and Sea Decree No 36/2014. All guest doing in water activity have to and abide by Raja Ampat Marine Protected Area Law.
14.6 Operator Cancellation (Exceptional Cases)
Refunds will only be considered if:
- The operator cancels the entire trip before commencement due to operational reasons.
- A refund, if approved, will be limited to the unused portion of the package only.
- Refunds do not include:
- Bank fees
- Transfer fees
- Currency exchange losses
14.7 Force Majeure
No refunds will be provided for cancellations caused by events beyond the operator’s control, including but not limited to:
- Natural disasters
- Extreme weather
- Pandemics or health emergencies
- Political instability
- Transportation disruptions
14.8 No-Show Policy
Failure to appear at the scheduled meeting point or departure time will be considered a no-show, and 100% of the booking value will be forfeited.
14.9 Refund Method
Approved refunds (if any) will be processed:
Using the original payment through wise transfer, or cash on site method
Within 14–30 business days
Minus applicable administrative and transaction fees
14.10 Acceptance
By confirming a booking and participating in the diving activities, guests acknowledge and agree that they fully understand and accept these Special Refund Terms & Conditions.
